Dock Restriction Update along with Misc. Items

TREE TOPS Update for December Dock Deed Restriction Issue Update As many of you know the board has been working hard to resolve our outstanding deed restriction issue with regards to a dock that was constructed in our community.   Last night, an informational meeting was held to brief the homeowners on the two options that the board is recommending.  The two options are listed below again: 1)      Enforcement of the provision (i.e. suit).  Under this provision there are several options available to us such as settling the case by mutually agreeing to some remedy or going to trial.  Deciding on the best course of action is a board decision.   The key points to make with regards to this option are that docks must adhere to our current guidelines and our costs to date could potentially be recovered.  Since 2005, approximately $14,000 has been spent.2)      Amend the declaration to allow for docks that are bigger and have roofs.   In order to amend the declaration the Board is creating a new declaration governing docks which in essence would move the Cuteri Dock into compliance and set a new standard going forward.   This would mean that each homeowner on the lake would be allowed to have a dock that meets the new governance (larger and have roofs).  Our declaration was originally written to keep the docks small in an effort to prevent any homeowners view from being obstructed by a proliferation of these types of structures.    A good part of the discussion last night focused on amending the declaration versus allowing just the Cuteri dock.   As stated in the previous emails and correspondence this can be referred to as selective enforcement and would allow the association to not enforce any restriction on future docks.  This is not a viable option for the association.  Next Steps Regarding the Dock The Board is working to prepare a proposed amendment to the declaration.  Within the next couple of weeks you will be mailed a proxy that allows you to vote on Enforcement of the current declaration provision or amending the declaration to allow larger docks.   The proposed amendment to the declaration will be included. In order to amend the declaration, 75 homeowners would need to vote by proxy or in person at the January meeting to change declaration to allow bigger docks with roofs. Even if you plan to attend the January meeting we are going to ask that each and every homeowner mail in their proxy.   If you attend the meeting in January, we can always give you back your proxy if you prefer to vote at the meeting. I try very hard to word these emails in a non confrontational manner.   My intent is to state the issue and potential resolutions as succinctly as possible and give options to the homeowners to express their desires on the course of actions we take.   While I have may have my personal opinions on certain matters, I will never let this influence our course of action.   The homeowners of Tree Tops will decide our course of action on these major decisions.    Please take the time to complete the proxy in December to vote your desired course of action.   Our intent with holding this meeting and distributing the information we have is for all of you to be able to make a well informed decision.  This is our primary responsibly as board members. Miscellaneous Items ·         A plug was installed on the fence that surrounds the well pump by the playground.   This was asked for by residents that may use the area for future neighborhood events.·         We are getting bids for pressure washing the walkway by the gazebo and the playground area.·         We are getting bids for enabling the pedestrian walkway gate with a swipe card or key.  There is currently a key lock system however to the best of my knowledge no resident has a key for this gate. Future Meetings Please keep your thoughts coming and let us know if there are items you would like covered at future board meetings.  You can email me at Brian.Bradway@RaymondJames.Com
